1. Acceptance of Terms
Welcome to Expert Witness Insights ("Platform," "we," "us," or "our"), operated by ESG Intelligence Private Limited, a company registered in New Delhi, India.
By creating an account, accessing our website, or using any of our services, you agree to be bound by these Terms of Use ("Terms"), our Privacy Policy, and all other policies referenced herein.
If you do not agree to these Terms, you must not use our Platform.
2. About Expert Witness Insights
Expert Witness Insights is an online directory and marketing platform that helps expert witnesses:
- Create professional profiles showcasing their expertise, credentials, and experience
- Get discovered by attorneys and legal professionals searching for expert witnesses
- Optimize their profiles for AI-powered legal research tools including ChatGPT, Claude, Perplexity, and other AI systems
- Build their professional presence in the legal services marketplace
Important: We are a marketing and directory platform. We do not:
- Match attorneys with experts
- Verify expert credentials or qualifications
- Provide legal advice or expert witness services
- Facilitate engagements between attorneys and experts
- Guarantee any business results or client inquiries
3. CourtListener Data and Court Records
3.1 Data Source and Attribution
Expert Witness Insights may display public court data sourced from CourtListener, a project of the Free Law Project. This includes case information, docket details, party names, and attorney information from publicly available court records and PACER filings.
Court data is in the public domain and is not subject to copyright restrictions. We provide proper attribution to CourtListener and the Free Law Project as required by their API Terms of Service.
3.2 Use of Court Data and Attorney Information
When using court data and attorney information on our Platform, you agree to:
- Lawful purposes only: Use court information only for legitimate professional purposes, case evaluation, and legal research;
- No contact harassment: Do not use attorney contact information for spam, unsolicited marketing, or harassment;
- No data resale: Do not resell, license, or commercially exploit attorney or court data;
- Respect privacy: Do not use attorney information in violation of privacy laws or anti-spam regulations;
- Professional conduct: Conduct all communications with attorneys in a professional, respectful manner;
- Comply with law: Follow all applicable laws including GDPR, CCPA, India's Digital Personal Data Protection Act, and similar privacy regulations.
3.3 Data Accuracy and Disclaimer
We provide court data as-is from public records. We do not guarantee:
- Accuracy or completeness of court information;
- Timeliness of case updates or status;
- Correctness of attorney contact information;
- Verification of party identities or credentials.
We recommend verifying all court information through official court sources and contacting courts directly before relying on case data for critical decisions.
3.4 Prohibited Uses of Court Data
You agree NOT to:
- Scrape, crawl, or bulk download court data without authorization;
- Create competing products using CourtListener data as the primary source;
- Harvest attorney contact information for mass mailing or spam;
- Violate CourtListener's API terms or rate limits;
- Share court data with data brokers or marketing companies;
- Use court information to create unsolicited marketing lists;
- Violate the intellectual property rights of the Free Law Project or CourtListener.
4. Your Free Profile
3.1 What's Included
When you create a free account on Expert Witness Insights, you can:
- Create and publish your expert witness profile
- Edit your profile anytime you want
- Include your biography, credentials, education, professional experience, areas of expertise, case experience, and contact information
- Upload one professional photo
- Add links to publications, media appearances, professional websites, and other credibility-building materials
- Control visibility by making your profile public or private
- Delete your account anytime through self-service tools
3.2 Free Forever
Your basic profile is free forever. There are no hidden fees, forced upgrades, or expiration dates.
However: These Terms are subject to change, and we reserve the right to modify our services or introduce new features. Any changes to pricing or service structure will be communicated to you in advance.
3.3 Account Requirements
To create a profile, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into binding agreements
- Possess genuine professional qualifications and experience as an expert witness or in a field where expert testimony is provided
- Provide accurate and truthful information
- Use a valid email address that you control
3.4 Account Security
You are responsible for:
- Maintaining the confidentiality of your password
- All activities that occur under your account
- Notifying us immediately at [email protected] if you suspect unauthorized access
4. AI Optimization & Transparency
4.1 How We Optimize for AI Discovery
Expert Witness Insights structures your profile data to be discoverable by AI-powered legal research tools. This is a core feature of our platform.
What we do:
- Format your profile using Schema.org markup and JSON-LD structured data
- Implement FAQ schema to help AI systems understand your expertise
- Optimize your profile content for natural language queries used by AI systems
- Structure your credentials, experience, and expertise in ways that AI tools can interpret accurately
- Make your profile indexable by AI-powered search engines and legal research platforms
4.2 Third-Party AI Systems
Important Disclosure: We optimize your profile for discovery by third-party AI systems including ChatGPT (OpenAI), Claude (Anthropic), Perplexity, and other AI-powered legal research tools.
What this means:
- Your public profile information may be indexed by these AI systems
- Attorneys using AI tools to search for expert witnesses may discover your profile through these systems
- We structure your data to maximize accurate representation in AI-generated responses
4.3 What We Cannot Control
While we optimize your profile for AI discovery, we cannot control:
- How third-party AI systems interpret or present your information
- The accuracy of AI-generated summaries or recommendations
- Which AI systems choose to index your profile
- How often AI systems update their information about you
- Whether AI systems display your profile in response to specific queries
4.4 AI Errors and Disclaimers
AI systems can make mistakes. Third-party AI tools may:
- Misinterpret your credentials or experience
- Generate inaccurate summaries of your expertise
- Hallucinate or fabricate information not present in your profile
- Fail to update outdated information
We are not responsible for errors, omissions, or misrepresentations made by third-party AI systems. If you discover inaccuracies in how AI tools represent your profile, contact us at [email protected] and we will work to optimize your profile for better accuracy.
4.5 Privacy and AI Indexing
By making your profile public, you consent to:
- Your profile being indexed by search engines and AI systems
- Your professional information being included in AI training datasets
- AI tools accessing and processing your profile data to answer legal research queries
If you want to opt out: You can make your profile private at any time, which will prevent public indexing. However, this significantly reduces your discoverability.
5. Content Ownership
5.1 You Own Your Content
You retain full ownership of all content you upload to your profile, including:
- Your biography and professional descriptions
- Your credentials, education, and experience
- Your photographs
- Links to your publications and media
- Any other original content you create
5.2 License You Grant Us
By uploading content to Expert Witness Insights, you grant us a limited, non-exclusive, worldwide license to:
- Display your content on our platform
- Optimize your content for search engines and AI discovery
- Structure your data using Schema.org, JSON-LD, and other technical formats
- Store your content on our servers
- Make your content accessible to attorneys, legal professionals, and AI systems (when your profile is public)
What we will NOT do:
- Sell your content to third parties
- Claim ownership of your content
- Use your content for purposes unrelated to operating our platform
- Modify your content without your permission (except for formatting and optimization)
5.3 Platform Ownership
Expert Witness Insights owns all rights to:
- The platform software and technology
- The Expert Witness Insights name, logo, and branding
- The AI optimization algorithms and techniques we use
- Any content we create (such as blog posts, guides, or marketing materials)
6. Your Responsibilities
6.1 Accuracy and Truthfulness
You represent and warrant that all information in your profile is:
- Accurate and truthful
- Complete and not misleading
- Current and up-to-date
- Verifiable if questioned
This includes:
- Your professional credentials, licenses, and certifications
- Your education and training
- Your case experience and testimony history
- Your areas of expertise
- Your contact information
You must promptly update your profile if any information changes, including:
- Changes to licensure status
- Loss or suspension of certifications
- Changes to contact information
- Significant changes to your expertise or experience
6.2 Professional Ethics
You agree to:
- Comply with all applicable professional ethics rules and standards in your field
- Maintain appropriate professional boundaries with attorneys who contact you
- Not engage in solicitation prohibited by legal ethics rules
- Disclose any conflicts of interest to attorneys who contact you
6.3 Attorney Responsibilities
For attorneys and legal professionals using our platform: You acknowledge that:
- We do not verify expert credentials or qualifications
- You must conduct your own due diligence before engaging any expert
- You remain responsible for expert selection and vetting
- You must comply with all applicable ethics rules regarding expert witness engagement
- AI-discovered experts require the same vetting as experts found through traditional means
7. Prohibited Conduct
You may not:
7.1 False Information
- Provide false, misleading, or deceptive information in your profile
- Fabricate credentials, licenses, or certifications
- Exaggerate your qualifications or experience
- Claim expertise you do not possess
- Create fake testimonials or case results
7.2 Impersonation
- Impersonate another person or entity
- Create a profile for someone else without permission
- Use someone else's credentials or photograph
7.3 Spam and Abuse
- Create multiple duplicate profiles
- Send unsolicited communications to attorneys or other users
- Engage in spamming, phishing, or fraudulent activities
- Use automated systems (bots, scrapers) to access our platform
7.4 Intellectual Property Violations
- Upload content you don't own or have permission to use
- Infringe on others' copyrights, trademarks, or intellectual property
- Use copyrighted photographs without permission
7.5 Harmful Content
- Upload illegal, offensive, or inappropriate content
- Post content that violates professional ethics rules
- Include discriminatory or harassing language
7.6 Platform Abuse
- Attempt to hack, disable, or interfere with our platform
- Reverse engineer our AI optimization techniques
- Scrape or download large amounts of data from our platform
- Use our platform for any illegal purpose
8. Optional Premium Services
8.1 What We Offer
In addition to your free profile, Expert Witness Insights offers optional premium services including:
- Insights Package: AI-optimized content creation for your profile
- Case Intelligence Package: Attorney networking data and recently concluded case information
- Website Package: Professional expert witness website development
8.2 Separate Agreement
Important: Premium services are governed by a separate Premium Service Agreement that includes:
- Pricing and payment terms
- Service descriptions and deliverables
- Billing and subscription details
- Refund and cancellation policies
- Service-specific terms and obligations
The Premium Service Agreement is presented to you at the time you inquire about or purchase premium services. Your use of premium services is governed by both these Terms and the Premium Service Agreement.
8.3 Free Profile Unaffected
Your free profile remains free regardless of whether you purchase premium services. Canceling premium services does not affect your free profile.
9. Important Disclaimers
9.1 No Credential Verification
WE DO NOT VERIFY, VALIDATE, OR CONFIRM:
- Expert credentials, licenses, or certifications
- Educational backgrounds or degrees
- Professional experience or case history
- Areas of expertise or qualifications
- Accuracy of any information in expert profiles
Attorneys and legal professionals are solely responsible for conducting their own due diligence before engaging any expert witness.
9.2 Not Legal Services
We are not a law firm and do not provide legal services or legal advice. Nothing on our platform constitutes:
- Legal advice or recommendations
- Attorney-client relationships
- Endorsement of any expert witness
- Guarantees about expert qualifications or performance
9.3 No Endorsement
Listing on our platform does not constitute endorsement. We do not:
- Recommend specific experts
- Endorse any expert's qualifications or services
- Guarantee the quality or reliability of any expert
- Vouch for any expert's credentials or experience
9.4 No Guarantee of Results
We make no guarantees about:
- How many attorneys will view your profile
- Whether you will receive inquiries or engagements
- Your ranking or visibility in search results
- AI systems discovering or recommending you
- Business results or income from using our platform
9.5 Platform Availability
"AS IS" BASIS: Our platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Uninterrupted or error-free operation
- Security or freedom from viruses
We do not guarantee that:
- Our platform will always be available or operational
- AI optimization will work as expected
- Third-party AI systems will accurately represent your profile
- Your profile will be discoverable in search results
10. Limitation of Liability
10.1 Scope of Limitation
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
ESG Intelligence Private Limited, Expert Witness Insights, and our directors, officers, employees, agents, and service providers SHALL NOT BE LIABLE for any:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, business opportunities, or goodwill
- Loss of data or information
- Cost of obtaining substitute services
- Damages arising from use or inability to use our platform
- Damages arising from errors, omissions, or inaccuracies in expert profiles
- Damages arising from AI systems' interpretation or representation of profiles
- Damages arising from interactions between attorneys and experts
- Damages arising from expert misconduct or malpractice
10.2 Maximum Liability
OUR TOTAL LIABILITY to you for any claim arising from or related to these Terms or our platform shall not exceed the greater of:
- The amount you paid us (if any) in the 12 months preceding the claim, OR
- One hundred U.S. dollars (USD $100)
10.3 Basis of Bargain
You acknowledge that:
- These limitations reflect the allocation of risk between us
- We would not provide free services without these limitations
- These limitations apply even if any remedy fails of its essential purpose
10.4 Indemnification
You agree to indemnify, defend, and hold harmless ESG Intelligence Private Limited, Expert Witness Insights, and our directors, officers, employees, agents, and service providers from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
- Your use of our platform
- Your violation of these Terms
- Your violation of any law or regulation
- Your violation of any third-party rights
- False, misleading, or inaccurate information in your profile
- Your professional services or expert witness work
- Any dispute between you and another user
11. Account Termination
11.1 Your Right to Terminate
You may delete your account at any time using self-service tools in your dashboard or by emailing us at [email protected].
Upon deletion:
- Your profile will be removed from public view
- Your account will be deactivated
- Your content will be removed from our active systems
However:
- AI systems may retain cached versions of your profile
- We may retain certain data for legal or operational purposes
- Some data may persist in backups for a limited period
11.2 Our Right to Terminate
We may suspend or terminate your account immediately, without notice, if you:
- Violate these Terms
- Provide false or misleading information
- Engage in fraudulent or abusive conduct
- Violate professional ethics rules
- Engage in illegal activities
- Abuse our platform or other users
- Create multiple accounts to evade restrictions
We also reserve the right to terminate any account for any reason or no reason, with or without notice, at our sole discretion.
11.3 Effect of Termination
Upon termination:
- Your right to use the platform immediately ceases
- We may delete your profile and content
- You remain responsible for any obligations incurred before termination
- Sections of these Terms that by their nature should survive (including disclaimers, limitations of liability, and dispute resolution) will continue to apply
12. Changes to These Terms
12.1 Right to Modify
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms on our website
- Updating the "Last Updated" date at the top of this page
- Sending you an email notification (for significant changes)
12.2 Your Acceptance
Your continued use of our platform after changes are posted constitutes your acceptance of the updated Terms.
If you do not agree to the modified Terms, you must stop using our platform and may delete your account.
12.3 Review Responsibility
It is your responsibility to review these Terms periodically. We encourage you to check this page regularly for updates.
13. Governing Law and Disputes
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
13.2 Jurisdiction
You agree that any legal action or proceeding arising from these Terms or your use of our platform shall be brought exclusively in the courts of New Delhi, India.
You hereby consent to the personal jurisdiction and venue of such courts and waive any objection to jurisdiction or venue.
13.3 Informal Resolution
Before filing any legal action, you agree to first contact us at [email protected] with a detailed description of the dispute.
We will attempt to resolve the matter through good-faith negotiation within 30 days.
13.4 Arbitration (Optional)
If informal resolution fails, either party may elect to resolve the dispute through binding arbitration administered by a mutually agreed arbitration body in New Delhi, India, in accordance with Indian arbitration law.
Arbitration proceedings shall be conducted in English.
13.5 Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION, WHETHER IN ARBITRATION OR COURT, WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
You waive any right to participate in a class action lawsuit or class-wide arbitration.
13.6 Time Limitation
You agree that any claim or cause of action must be filed within one (1) year after the claim arose, or such claim shall be permanently barred.
13.7 Exceptions
Either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent infringement of intellectual property rights or other irreparable harm.
14. General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and ESG Intelligence Private Limited regarding use of the platform.
14.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, severed from these Terms. The remaining provisions shall continue in full force.
14.3 Waiver
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
14.4 Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms at any time without your consent, including in connection with a merger, acquisition, or sale of assets.
14.5 No Agency
No agency, partnership, joint venture, or employment relationship is created between you and ESG Intelligence Private Limited as a result of these Terms or your use of our platform.
14.6 Force Majeure
We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, labor disputes, government actions, internet failures, power outages, or cyberattacks.
14.7 Language
These Terms are written in English. Any translated versions are provided for convenience only. In the event of any conflict, the English version shall prevail.
14.8 Survival
Provisions that by their nature should survive termination shall survive, including: content ownership, disclaimers, limitations of liability, indemnification, dispute resolution, and any obligations incurred before termination.
