2. Our Intellectual Property
2.1 Company-Owned Content
The following content and materials are owned by ESG Intelligence Private Limited or Expert Witness Insights and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws of India and other jurisdictions:
- Website Design: Overall design, layout, visual elements, color schemes, and user interface;
- Branding: Logos, brand names, taglines, and trademarks ("Expert Witness Insights," "EWI," and related marks);
- Written Content: Original articles, guides, marketing materials, help documentation, and website copy;
- Software and Code: Website code, applications, scripts, databases, and technical infrastructure;
- AI Systems: Proprietary AI algorithms, models, optimization methodologies, and data structures;
- Database Compilation: The compilation, organization, and structure of expert profiles and data;
- Graphics and Media: Icons, illustrations, graphics, images, and videos created by or for the Company;
- Templates and Tools: Profile templates, article templates, website templates, and platform tools;
- Documentation: User manuals, technical documentation, and instructional materials.
2.2 All Rights Reserved
All rights to Company-owned content are expressly reserved. Without our prior written consent, you may NOT:
- Copy, reproduce, distribute, republish, download, or display any Company-owned content;
- Modify, adapt, translate, or create derivative works from our content;
- Use our trademarks, logos, or brand elements in any manner;
- Reverse engineer, decompile, or disassemble our software, code, or AI systems;
- Use our content for commercial purposes or financial gain;
- Remove, alter, or obscure any copyright notices, trademarks, or other proprietary rights notices;
- Frame, mirror, or incorporate our content into another website or application;
- Use automated systems (bots, scrapers, crawlers) to copy or download content in bulk;
- Sublicense, sell, rent, lease, or transfer any rights to our content.
2.3 Limited License to Users
We grant you a limited, non-exclusive, non-transferable, revocable license to:
- Access and view content on our website for personal, non-commercial use;
- Print individual pages for personal reference (not for distribution);
- Share links to our content on social media or via email;
- Quote brief excerpts (with proper attribution) in accordance with fair use principles.
This license does NOT transfer any ownership rights to you and may be terminated at any time by us.
3. User-Generated Content
3.1 Ownership of User Content
You retain ownership of original content you submit to our platform, including:
- Written Content: Profile information, biographical text, methodology descriptions, and any original text you write;
- Images: Photographs, headshots, professional images, and graphics you upload;
- Publications: Articles, papers, books, and other publications you reference or upload;
- Videos: Video content you create and provide for your profile;
- Testimonials: Testimonials, case studies, or client feedback you provide;
- Other Materials: Any other original creative works you submit.
Important: You only retain ownership of content you created or for which you hold the necessary rights. You do NOT own third-party content, copyrighted materials, or content provided by others.
3.2 License Grant to Company
By submitting content to our platform, you grant ESG Intelligence Private Limited and Expert Witness Insights a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to:
- Use and Display: Use, reproduce, and display your content on our platform and in connection with our services;
- Modify and Format: Modify, adapt, edit, and format your content for optimal presentation on the platform (including AI optimization, Schema markup, and structured data generation);
- Distribute: Distribute your content through our services, including making it available to search engines and AI systems;
- Structured Data: Include your content in structured data formats (Schema.org, JSON-LD, FAQ schema, Article schema) for enhanced discoverability;
- Marketing: Use your name, likeness, profile photo, and professional information in connection with marketing and promotion of our platform (with your consent);
- Sublicense: Sublicense these rights to third-party service providers who assist in operating our platform (hosting providers, CDNs, analytics providers, etc.);
- Archive: Retain copies for archival, backup, legal compliance, or dispute resolution purposes.
3.3 Duration of License
The license granted in Section 3.2 continues for as long as:
- Your content remains on our platform; OR
- Your account is active; OR
- We have a legitimate need to retain the content (legal compliance, dispute resolution, backups).
When you delete content or terminate your account, we will make reasonable efforts to remove your content from public view within a reasonable timeframe (typically 7-30 days). However:
- Copies may persist in backups, caches, or archives for up to 90 days;
- We may retain content as required by law or for legitimate business purposes;
- Third-party systems (search engines, AI systems, web archives) may retain cached or indexed copies that we cannot control.
3.4 User Representations and Warranties
By submitting content, you represent and warrant that:
- Ownership or Rights: You own or have all necessary rights, licenses, consents, and permissions to use and authorize us to use the content;
- No Infringement: The content does not infringe any third party's intellectual property rights, including copyrights, trademarks, patents, trade secrets, or other proprietary rights;
- No Privacy Violations: The content does not violate any third party's privacy rights, publicity rights, or confidentiality obligations;
- Permission for People: You have obtained necessary permissions and releases from any individuals depicted in photographs, videos, or other content;
- No Unlawful Content: The content does not violate any applicable laws, regulations, court orders, or professional codes of conduct;
- Accuracy: Any factual claims in your content (credentials, experience, case results) are true, accurate, and not misleading;
- No Confidential Information: The content does not include confidential case information, attorney-client privileged communications, work product, or other protected information;
- Original or Licensed: The content is either your original creation or properly licensed from third parties with permission to use on our platform.
3.5 Prohibited Content
You agree NOT to submit content that:
- Infringes copyrights, trademarks, patents, or other intellectual property rights;
- Violates privacy rights, publicity rights, or confidentiality agreements;
- Contains plagiarized or improperly attributed content;
- Includes third-party copyrighted materials without proper licensing or fair use justification;
- Uses trademarked names, logos, or brands without authorization;
- Contains false or misleading copyright notices;
- Violates any professional ethical rules or court orders;
- Includes malicious code, viruses, or harmful software.
4. AI-Generated Content
4.1 AI Content Created for Users
When we use AI to generate or assist in creating content for you as part of premium services (Insights Package, Case Intelligence Package, Website Package), the following applies:
Ownership and Licensing:
- User License: You receive a non-exclusive, worldwide, royalty-free license to use the AI-generated content for your profile, website, and professional purposes;
- Company Ownership: We retain ownership of underlying AI systems, algorithms, models, methodologies, and infrastructure;
- No Transfer of Ownership: The license does not transfer ownership of the AI-generated content to you;
- Modification Rights: You may edit, modify, adapt, and customize AI-generated content as needed;
- Approval Required: Publication of AI-generated content requires your explicit review and approval;
- No Guaranteed Rights: We do not guarantee that AI-generated content is free from copyright claims or that it does not infringe third-party rights;
- User Responsibility: You are responsible for ensuring AI-generated content is appropriate, accurate, and non-infringing before publication.
AI Content Limitations:
- AI-generated content may inadvertently include copyrighted elements from training data;
- We do not warrant that AI-generated content is original or free from plagiarism;
- You should review AI-generated content for potential copyright issues before publication;
- We are not liable for copyright claims arising from AI-generated content you approve and publish.
4.2 AI Training and Learning
Our AI systems may learn from and analyze content on our platform to improve services. By using our platform, you consent to:
- AI Analysis: AI analysis of your content for optimization, categorization, and quality improvement purposes;
- Aggregated Data: Use of anonymized and aggregated data to improve AI systems and platform functionality;
- Pattern Recognition: AI identification of patterns, trends, and insights from platform content;
- Internal Use Only: We do NOT sell or license your content to third parties for AI training purposes;
- Third-Party AI: We do NOT intentionally provide your content to third-party AI systems (ChatGPT, Claude, etc.) for training, though these systems may index your public profile independently.
4.3 Third-Party AI Indexing
Your public profile may be indexed by third-party AI systems (search engines, AI assistants, legal research tools). Important considerations:
- Public Content: Content in your public profile is accessible to AI crawlers and bots;
- No Control: We cannot control how third-party AI systems use, store, train on, or present your content;
- Opt-Out Limited: Making your profile private prevents new indexing, but cannot remove content already indexed by third parties;
- Copyright Remains: You retain copyright in your content even when indexed by third-party AI systems;
- Fair Use Considerations: Third-party AI use of your content may be considered fair use under applicable copyright laws;
- No Liability: We are not responsible for third-party AI systems' use of your content.
5. Copyright Infringement Reporting (DMCA/Takedown Procedures)
We take copyright infringement seriously and will respond to valid notices of alleged copyright infringement in accordance with applicable copyright laws, including the Digital Millennium Copyright Act (DMCA) in the United States and similar laws in other jurisdictions.
5.1 Filing a Copyright Infringement Notice
If you believe that content on our platform infringes your copyright, please submit a written notification to our designated copyright agent containing the following information:
Required Information:
- Signature: A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner;
- Copyrighted Work: Identification of the copyrighted work claimed to have been infringed, including:
- Title of the work;
- Copyright registration number (if registered);
- Description of the work;
- If multiple works, a representative list.
- Infringing Material: Identification of the material claimed to be infringing, including:
- Specific URL(s) where the infringing material is located on our platform;

5.3 Our Response to Valid Notices
Upon receipt of a valid copyright infringement notice, we will:
- Review: Promptly review the notice for completeness and validity;
- Remove or Disable: Remove or disable access to the allegedly infringing material if the notice is complete and valid;
- Notify User: Notify the user who posted the material about the takedown;
- Provide Counter-Notice Option: Inform the user of their right to file a counter-notification (see Section 5.4);
- Documentation: Maintain records of the notice and our response.
We aim to respond to valid notices within 2-5 business days.
5.4 Counter-Notification
If you believe your content was wrongly removed or disabled due to a mistake or misidentification, you may submit a counter-notification containing:

- Identification: Identification of the removed material and its location before removal (URL);
- Good Faith Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;

- Consent to Jurisdiction: A statement that you consent to the jurisdiction of the appropriate court in New Delhi, India, or if you are located outside India, to the jurisdiction of the courts where the copyright owner is located;
- Service of Process: A statement that you will accept service of process from the person who filed the original DMCA notice or their agent.
Counter-Notification Process:

- If the complainant does not file a court action within 10-14 business days, we may restore the removed content;
- We are not obligated to restore content and reserve the right to make a final determination.
5.5 Repeat Infringers
We maintain a policy of terminating accounts of repeat infringers in appropriate circumstances. Specifically:
- Three Strikes: Users who receive three (3) valid copyright infringement notices may have their accounts suspended or terminated;
- Flagrant Violations: Accounts may be terminated immediately for egregious or intentional copyright infringement;
- Review Process: Users may appeal terminations by providing evidence that the notices were invalid or content was non-infringing;
- Permanent Ban: Repeat infringers may be permanently banned from creating new accounts.
5.6 False or Fraudulent Notices
Submitting false or fraudulent copyright infringement notices is illegal and may result in civil and criminal penalties.
- False notices may subject you to liability for damages, attorneys' fees, and court costs;
- Perjury charges may apply for false statements made under penalty of perjury;
- We may ban users who submit false or abusive notices;
- We may pursue legal action against parties who submit false notices.
Only submit a notice if you genuinely believe your copyright has been infringed. If you are unsure, consult an attorney.
6. Trademark Policy
6.1 Our Trademarks
The following are trademarks owned by ESG Intelligence Private Limited or Expert Witness Insights:

- "EWI" (abbreviation/logo mark);
- The Expert Witness Insights logo and design elements;
- Service names and branded features (Insights Package, Case Intelligence Package, Website Package);

- Alter, modify, or create derivative versions of our trademarks.
